Terms of use
These are the terms on which Imperial Resources Limited, trading as The Crest, of 25 The Willows, Castlemagner, Mallow, Co. Cork, provides club websites, booking, fixtures and the club lottery module.
They are between The Crest and the club. A person booking a pitch on a club's website is contracting with that club, under the club's own terms, and not with The Crest.
1. The subscription
A club subscribes for a term, paid in advance. What is included at each price is set out on the pricing page at the time the club subscribes.
Either side may end the subscription at the end of a term by telling the other before it renews. The Crest may end it immediately if a club does not pay, or if clause 5 is breached.
2. The club's site is the club's
The club owns its content — its words, its photographs, its crest, its fixtures, its member list. The Crest claims nothing in it and will not use it for anything except running the site.
The club may take it with it. An export of everything is available from the admin area at any time, and for thirty days after the subscription ends.
The Crest owns the software.
3. Data protection
For personal data on the club's website, the club is the controller and The Crest is the processor. The data processing agreement governs that and forms part of these terms.
The club is responsible for its own compliance: for having a lawful basis for what it collects, for answering its members' requests, and for the accuracy of its own privacy notice.
The Crest generates a privacy notice, a cookie notice and terms for each club site, filled in from the club's details, as a starting point that is correct for what the software actually does. It is a starting point and not legal advice. A club that collects personal details in any other way must say so, and the notice has a place for that. If in doubt, the club should take its own advice.
4. Payments
Bookings, shop orders, donations and lottery entries are paid directly to the club, into the club's own Stripe account. The money does not pass through The Crest and The Crest takes no cut of it.
That also means refunds, chargebacks and disputes are between the club and the payer. The Crest provides the buttons; the club is the merchant.
The club is responsible for its own Stripe account, for the accuracy of its prices, and for meeting its obligations as a seller.
5. What a club may not do
- Hold information about anybody under eighteen. The system has no place for it and the club must not force one.
- Run a lottery without a valid permit or licence, or in breach of its terms. See clause 6.
- Publish anything unlawful, defamatory, or infringing somebody else's rights.
- Resell the service, or use it to host a site that is not a club's.
- Attack the service, or try to reach another club's data.
6. The club lottery
The lottery module is switched off until a club asks for it, records the permit or licence it holds, and accepts a separate warranty confirming that it is the promoter and that it is responsible for compliance.
The club is the promoter. The Crest provides software and is not a promoter, a licensee, or a party to any draw. The club is responsible for the permit, the prize limits, the conduct of the draw, and everything the Gaming and Lotteries Acts and the Gambling Regulation Act 2024 require of it.
The Crest may switch the module off for a club, or across the platform, immediately and without notice, if there is reason to think it is being used outside the law.
7. What The Crest promises, and does not
The Crest will provide the service with reasonable skill and care, and will try to keep it available — but does not promise it will never be down. Maintenance, an outage at a hosting or payment provider, and things outside reasonable control all happen.
Nothing here limits liability for death, personal injury, or fraud.
Otherwise The Crest's total liability in any twelve months is limited to the fees the club paid in those twelve months, and The Crest is not liable for lost revenue, lost fundraising, or losses it could not reasonably have foreseen.
8. Changes
The Crest may change these terms, and will tell clubs by email at least thirty days before a change that materially affects them. A club that does not accept such a change may end the subscription and be refunded the unused part.
